Terms & Conditions
Last updated: October 5, 2026
These terms and conditions set out the rules of the Punkto loyalty program, including registration, how points are earned and redeemed, and the rights and obligations of participants.
1. General provisions
The organizer of the Punkto loyalty program ("Program") is Clean Whale Sp. z o.o., based in Kraków at ul. Grzegórzecka 43/2, 31-532 Kraków, Polska, entered in the National Court Register (KRS) under number 0000868230, NIP 6751738063, REGON 387455114 ("Organizer", "Punkto").
The Program is available through the Punkto mobile app and the punkto.club website ("App").
Participation in the Program is voluntary and free of charge.
2. Definitions
- Participant — an individual who has created an account in the App and takes part in the Program.
- Partner — a business that has entered into an agreement with the Organizer to take part in the Program and that lets Participants earn and redeem Points on purchases made with it.
- Points — units of account earned and redeemed within the Program in accordance with these terms.
- Account — a Participant’s individual account in the App, linked to a phone number.
- Balance — the current number of Points held in a Participant’s Account.
3. Conditions of participation
A Participant in the Program may be an individual who is at least 18 years old and has full legal capacity, or an individual who is at least 13 years old, provided they have obtained the consent of their legal guardian.
Registration in the Program takes place by creating an Account in the App and verifying a phone number with an SMS code.
Only one Account may be linked to a given phone number.
4. How Points are earned
For every full 10 zł spent with a Partner taking part in the Program, the Participant earns 1 Point, unless the Partner sets a different earning rate, shown in the App before the purchase is made.
Points are credited to the Participant’s Balance once the transaction is confirmed by the Partner.
1 Point is worth 1.00 zł when Points are used as payment for purchases, in accordance with the rules described in Section 6.
Points are not electronic money or a means of payment within the meaning of applicable law and cannot be exchanged for cash.
5. Referral program
Every Participant receives a unique referral link in the App, which they may share with others.
- A person who creates an Account using a referral link receives a one-time bonus of 50 Points.
- The referring Participant receives 100 Points once the person they referred completes their first purchase with a Partner through the Program.
The Organizer reserves the right to limit the number of bonuses awarded under the referral program if abuse is suspected (e.g. registrations using the same details or device).
6. Redeeming Points
Accumulated Points may be used as payment (in full or in part) for purchases with any Partner taking part in the Program.
- A Partner may set a maximum percentage of a transaction’s value that may be paid with Points.
- Points are redeemed in whole units; they cannot be split.
- Points cannot be exchanged for cash or transferred to another Participant’s Account.
7. Validity of Points
Points remain valid for 12 months from the date they are earned. Once this period has elapsed, unused Points expire automatically.
The Organizer will notify the Participant of an upcoming expiry of Points via a notification in the App or by email.
8. Complaints
Complaints about the operation of the Program may be submitted to [email protected] or via the contact form in the App.
The Organizer will review complaints within 14 days of receipt and inform the Participant of the outcome.
9. Withdrawal and account deletion
A Participant may withdraw from the Program at any time by deleting their Account in the App settings.
Deleting an Account results in the loss of any unused Points held in the Balance, with no right to compensation.
The Organizer may suspend or delete a Participant’s Account if it determines that these terms have been violated, in particular attempts to abuse the referral program.
10. Liability
The Organizer is not the seller of goods or services offered by Partners and is not liable for their quality, conformity with description, or fulfillment — liability in this respect rests solely with the Partner.
The Organizer makes reasonable efforts to keep the App running continuously and without interruption, but does not guarantee uninterrupted availability of the App (including in connection with planned technical maintenance).
11. Personal data
The rules for processing Participants’ personal data in connection with participation in the Program are described in the Privacy Policy available on the Punkto website.
12. Changes to these terms
The Organizer may amend these terms for valid reasons, in particular in connection with changes in the law or the development of the Program.
The Organizer will notify Participants of any changes at least 14 days in advance via the App or by email. Continued use of the Program after the changes take effect constitutes acceptance of them.
13. Final provisions
Matters not covered by these terms are governed by Polish law.
The current version of these terms is always available in the App and on the Punkto website.
